Penalties for a 1st Offense DUI

  • 3 to 5 years informal probation
  • 48 hours to 6 months in jail
  • $390 to $1000 fine plus penalty assessments
  • 3-month alcohol program (9-month alcohol program if blood alcohol concentration was .20% or higher or for a chemical test refusal)
  • Suspension of your driving privileges

You will also face a potential driver’s license suspension based solely off of the arrest. This is determined by the Department of Motor Vehicles. You have 10 days to contact the DMV following an arrest for a San Diego DUI or your license will be automatically suspended.

  • 96 hours to 1 year in jail
  • 18-month to 30-month alcohol program
  • $390 to $1000 fine plus penalty assessments
  • Suspension of your driving privileges

If you are on probation for your 1st offense, you will face additional penalties. If you are driving on a suspended license and arrested for driving under the influence you could face mandatory jail time. Your vehicle could be subject to impoundment and you could be required to install an ignition interlock device.

Penalties for a 3rd Offense DUI

  • 3 to 5 years informal probation
  • 120 days to 1 year in jail
  • 18-month to 30-month alcohol program
  • $390 to $1000 fine plus penalty assessments
  • Revocation of your driving privileges

A 3rd conviction of driving under the influence within 10 years will severely increase the penalties that you face. Your fines and jail time will increase significantly.
